Resource Agility takes your individual right to privacy seriously and supports the amendments to the Privacy Act 1988. In a spirit of openness, we have addressed the new requirements of the Privacy Act in the following ways:

The National Privacy Principles established by the Privacy Act 1988 apply to Resource Agility Pty Ltd ABN 43 108 465 881.

Types of Information Held

Personal information that we collect and obtained usually falls into but is not limited to, the following categories.

Candidate information submitted and obtained from the Candidate and other sources in connection with applications for employment/work;
Work performance information
Information about incidents in the workplace
Staff information
Information submitted and obtained in relation to absences from work due to leave, illness and other causes;
Information obtained to assist in relation to absences from work due to leave, illness and other causes;
Clients information

Purposes for Which We hold Personal Information

We primarily hold personal information for the following:

Placement Operations
Recruitment
Staff management
Training
Client & business Relationship management
Marketing
Where applicable, contractor payroll and all related options

Such information forms an integral part of our business, being the business of recruitment, placement and management of personnel. These are naturally purposes which are incidental to these principal purposes.

Disclosures

We may disclose your personal information for the purposes for which it is primarily held or for a related secondary purpose. In some cases we may only disclose information with your consent, however by supplying us with your resume other otherwise requesting that we seek employment on your behalf, you will be taken to having consented to the Company using your personal and sensitive information for the above purposes and for purposes which incidental to those principal purposes.

We may disclose your purposes information where we are under a legal duty to do so, including circumstances where we are under a lawful duty of care to disclose information. The Company may sell the whole or part of it’s business, as your sensitive information will form part of the Company records and it may be disclosed for that purpose.

Consultants, Legal Advisors, Contractors, others

Resource Agility occasionally out sources some of our non-core business services and functions. Our suppliers may view some of your personal information. Typically our contractors would include:

IT support service providers
Finance and payroll service providers

The outsourcing of these services does not affect your ability to gain access to, change or delete your personal information as described below. Additionally, from time to time persons who are associated with or otherwise dealing with the company may have access to the Companies records. (which include sensitive information)

The Company is concerned that it’s information is treated confidentially, therefore such persons will be subject to an obligation to maintain such confidentiality. Such persons may include auditors, advisers, legal representatives and the others persons with whom the Company has entered into confidentiality agreements.

You must also be aware that such sensitive information may be made available to courts, government departments or other organisations who have legal entitlement to such information.

Access

Subject to some exceptions that are set out in the National Privacy Principles, you can gain access to the personal information that we hold about you. We will refuse access if it would interfere with the privacy rights of the other persons or if it breaches any confidentiality that attaches to that information. Further, access may be denied if the request for access is frivolous or vexatious.

If you wish to obtain access to your personal information you should contact our Privacy officer in writing. You may wish to gain access to some or all your personal information held by the Company. You will need to be in a position to verify your identity. There will be a charge for time utilised in providing access. Our Privacy officer would discuss these charges with you.

Your should also anticipate that it may take a little time to process your application for access as there may be a need to retrieve information from storage and review information in order to determine what information may be provided. As a general rule, the Company will acknowledge your request with 14 days and will include the cost of supply in that letter. Within one month from the receipt of payment, the personal information will be sent to you.

Applications for access to personal information must be made personally. Under no circumstance will your personal information be released to any representative. A fee of $50 per hour will apply for the supply of personal information to an individual
